(Web Desk Monitoring) — Following the Pakistani government’s declaration of a ban on the Pakistan Tehreek-e-Insaf (PTI) party, legal experts have weighed in on the legality and potential repercussions of this decision.

Retired Justice Shaiq Usmani emphasized that while the government possesses the constitutional authority to ban a political party, it is imperative to first refer the matter to the Supreme Court for final adjudication. He cited Article 17 of the constitution, affirming the right of individuals to join any party, but noting that a ban can be imposed if a party engages in activities deemed detrimental to national security. Usmani underscored the necessity for thorough investigations and the preparation of a comprehensive report before presenting the case to the Supreme Court.

Meanwhile, prominent lawyer Aitzaz Ahsan criticized the government’s move, describing it as “foolish.” He expressed concerns that the reference for the ban is driven by ulterior motives and predicted that it would ultimately backfire on the government. Ahsan suggested that the government’s actions were aimed at diverting attention from allegations surrounding the “Form 45” issue, which pertains to irregularities in PTI’s funding. He predicted that those responsible for any discrepancies in the form would face legal consequences.

The government’s decision to ban PTI was announced during a press conference led by Federal Information Minister Atta Tarar, who asserted that the party’s existence alongside national interests was untenable. Additionally, the government indicated its intention to seek a review of the Supreme Court’s recent ruling regarding reserved seats in the elections.
