IHC judge notes the current ‘flawed system’ during caretaker government tenure

ISLAMABAD (Daily Point) — The Islamabad High Court (IHC) criticised the caretaker government, expressing concern about a perceived “terrible system” prevailing in the country and questioning its impartiality.

Justice Miangul Hassan Aurangzeb remarked that a “terrible system” is in place under the caretaker setup, where even consultations for upcoming elections are allegedly being hindered. The judge raised doubts about the government’s intentions regarding the scheduled polls on February 8, asking if the caretaker government is aiming to disrupt the electoral process.

This query arose during the hearing of a petition filed by Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gauhar Khan and other lawyers. They sought permission to meet the party’s founder, Imran Khan, who is currently in jail. The legal team argued that the consultation with Khan was crucial, especially regarding the decision to distribute 700 party tickets as the elections approach.

The judge, in response to the plea, granted permission for the legal team to meet Imran Khan for consultations before the upcoming polls. The court’s order specified that the meeting should be supervised by the Adiala jail superintendent.

Highlighting the importance of allowing consultation for elections as a fundamental right, the court emphasized the party’s right to consult with its founder on matters related to tickets.

Furthermore, Justice Aurangzeb urged the caretaker government to maintain neutrality in the elections. The court’s order noted that opposition to the PTI founder’s consultation raised concerns about the government’s impartiality.

During the hearing, the additional attorney general and Adiala jail superintendent appeared before the court. Both officials faced objections from the attorney general and advocate general, drawing criticism from the judge. Justice Aurangzeb reminded them that their offices represent the caretaker government and should uphold impartiality, referencing a previous note from the Supreme Court.
